Mensana Collaborative is committed to ethical marketing, transparent communication, and compliance with all applicable federal and California laws governing healthcare advertising, referrals, and patient admissions. This policy describes the principles that guide Mensana Collaborative’s outreach, advertising, and referral practices.

 

COMMITMENT TO ETHICAL MARKETING

Mensana Collaborative strives to provide accurate, responsible information about mental health treatment services. All marketing and outreach activities are designed to:

  • Provide clear information about treatment services

  • Avoid misleading or deceptive statements

  • Support informed decision-making by patients and families

  • Comply with applicable healthcare advertising laws

 

Mensana Collaborative does not engage in marketing practices that exploit individuals seeking treatment.

 

TRUTHFUL ADVERTISING

Mensana Collaborative does not publish or promote misleading claims regarding treatment outcomes, success rates, or recovery statistics. Any statements regarding treatment effectiveness must be supported by credible clinical evidence or clearly described as general information about treatment approaches.

 

NO PATIENT BROKERING

Mensana Collaborative strictly prohibits patient brokering. Patient brokering occurs when individuals or organizations receive financial compensation in exchange for referring patients to treatment programs. Mensana Collaborative does not pay, offer, solicit, or receive referral fees or any form of remuneration in exchange for referring or receiving patients in violation of federal or California law.

 

COMPLIANCE WITH REFERRAL LAWS

Mensana Collaborative complies with applicable laws governing referrals, including:

  • California Business & Professions Code §650

  • The Federal Anti-Kickback Statute

  • Federal healthcare fraud and abuse laws

 

Relationships with healthcare professionals, referral sources, and service providers are structured to comply with these laws.

 

NO PAYMENT FOR PATIENT RECRUITMENT

Mensana Collaborative does not pay individuals to recruit patients, compensate call centers or marketers based on patient admissions, or provide financial incentives tied to patient enrollment. Mensana Collaborative does not purchase or sell patient leads in arrangements where compensation is based on patient admissions or insurance value. Marketing vendors may not represent themselves as independent treatment providers when acting on behalf of Mensana Collaborative. Any marketing vendors engaged by Mensana Collaborative are required to comply with ethical marketing standards and applicable healthcare laws.

 

PROHIBITION ON INDUCEMENTS

Mensana Collaborative does not offer cash payments, gifts, free travel, housing incentives, or other financial inducements to encourage individuals to enroll in treatment services where such practices would violate federal or California law.

 

ACCURATE REPRESENTATION OF SERVICES

Mensana Collaborative strives to ensure that information about treatment, clinical services, and outcomes is accurate and not misleading. Descriptions of treatment reflect the clinical approaches offered by Mensana Collaborative. Individual treatment outcomes vary and cannot be guaranteed.

 

RESPONSIBLE USE OF DIGITAL MARKETING

Mensana Collaborative may use digital marketing tools such as search engines, online directories, and social media to provide information about services. Digital outreach efforts are designed to:

  • Provide accurate program information

  • Direct individuals to legitimate admissions resources

  • Avoid deceptive marketing practices

 

Mensana Collaborative complies with applicable platform policies governing healthcare advertising, including requirements established by search engines and digital advertising platforms designed to prevent deceptive marketing.

 

Mensana Collaborative does not engage in practices intended to mislead individuals seeking treatment. Mensana Collaborative does not authorize third parties to represent themselves as Mensana Collaborative without written permission and does not permit third-party websites to impersonate or misrepresent Mensana Collaborative’ programs or admissions services.

 

RELATIONSHIPS WITH REFERRAL PARTNERS

Mensana Collaborative may collaborate with healthcare professionals, hospitals, therapists, and community organizations to support patient care. These relationships are based on clinical collaboration and shared commitment to patient wellbeing. Referral relationships are not based on financial incentives tied to patient admissions.

 

TRANSPARENCY IN ADMISSIONS

Mensana Collaborative admissions staff aim to provide clear and accurate information regarding treatment programs, admissions criteria, insurance verification, and financial responsibilities. Admissions staff may not misrepresent insurance coverage, network participation, expected out-of-pocket costs, or the likelihood of insurance reimbursement. Admissions decisions are based on clinical appropriateness and patient needs.

 

POLICY UPDATES

Mensana Collaborative may update this Ethical Marketing & Patient Referral Policy from time to time. Updated versions will be posted on the website with a revised effective date.

 

REPORTING CONCERNS
